Disclaimer
This Disclaimer applies to the Coached platform operated by Brave Systems Pty. Ltd. (trading as Yates Total Health) (the "Service"). It applies to everyone who uses the Service — Coaches who deliver coaching through it, and Clients who receive coaching through it.
This Disclaimer is incorporated into the Terms of Service. When you accept those Terms — or when, as a Client, you accept the consent declaration at intake — you also accept this Disclaimer.
1. The Service is not medical advice
The Service is a software platform for fitness and health coaching. It is not a medical device. It does not provide medical advice, diagnosis, treatment, or recommendations.
Information available through the Service — including programs, nutritional targets, body composition data, AI-generated suggestions, and educational content — is for general informational and coaching context only.
Always consult a qualified healthcare professional before:
- Starting any exercise program.
- Changing your diet or nutritional intake.
- Addressing any new or existing health concern.
- Stopping or changing any medical treatment.
If you experience symptoms that concern you, contact a qualified healthcare professional or, in an emergency, call 000 in Australia.
2. Coaches are independent professionals
Coaches who use the Service are independent professionals. They are not employees, agents, or representatives of Brave Systems Pty. Ltd. (trading as Yates Total Health).
Brave Systems Pty. Ltd. (trading as Yates Total Health) does not:
- Employ Coaches.
- Supervise the coaching they deliver.
- Certify the qualifications of Coaches.
- Endorse any specific Coach.
- Verify that a Coach holds particular qualifications, registrations, or insurance.
When you, as a Client, work with a Coach through the Service, your coaching relationship is with the Coach directly. Brave Systems Pty. Ltd. (trading as Yates Total Health) provides the software platform; the Coach provides the coaching.
3. Inherent risks of exercise and physical training
Physical exercise carries inherent risks. These include — but are not limited to — risk of:
- Muscle strain, ligament strain, and joint injury.
- Falls and impact injuries.
- Cardiovascular events (heart attack, stroke, fainting).
- Heat illness, dehydration, and over-exertion.
- Aggravation of pre-existing conditions or injuries.
- Adverse responses to nutritional changes.
By using the Service, you acknowledge these risks and accept responsibility for any exercise or nutritional practices you undertake.
You confirm that you have been advised to seek medical clearance from a qualified physician if you have any concerns about your health status prior to commencing training. If you have not done so, you should before continuing.
4. Your duty to disclose
If you are a Client using the Service, you are responsible for providing accurate, complete information at the health intake and throughout your use of the Service. Specifically:
- The information you provide at intake — including medications, surgeries, health screening answers, allergies, intolerances, and contraindications — must be accurate and complete to the best of your knowledge.
- It is your ongoing responsibility to inform your Coach of any changes to your health status, medical conditions, medications, or injuries that arise during your use of the Service.
Brave Systems Pty. Ltd. (trading as Yates Total Health) and your Coach accept no liability for adverse outcomes arising from information you have failed to disclose, including but not limited to undeclared medical conditions, undeclared injuries, undeclared medications, or undeclared contraindications to exercise.
5. No guarantee of results
Results from training programs and nutritional approaches vary widely based on individual factors — including but not limited to genetics, age, sex, baseline fitness, baseline body composition, adherence, sleep, stress, and overall lifestyle.
Brave Systems Pty. Ltd. (trading as Yates Total Health) makes no guarantee — express or implied — of any specific outcome, including (without limitation):
- Strength gains.
- Muscle gain.
- Fat loss.
- Body composition change.
- Athletic performance.
- Health improvement.
Statements about typical outcomes, success stories, or before-and-after results (whether on the Service itself or in any marketing materials) are descriptive of past results for particular individuals. They are not predictions of, or promises about, your individual results.
6. Health data displayed through the Service
The Service displays health-related data including (where you choose to record it):
- Bodyweight and body composition.
- Heart rate variability (HRV), resting heart rate, sleep duration and stages, sleep efficiency, blood oxygen (SpO2), respiratory rate, skin temperature, steps, workout strain and load, and a computed recovery score — from a connected wearable or your device health platform (Apple Health on iOS, Google Health Connect on Android where available, or WHOOP) where you grant permission.
- Self-reported sleep quality, energy, stress, and soreness.
- Nutritional intake.
- Training load.
This data is shown to you and to your Coach as part of the coaching context. It is not diagnostic. It should not be used to make medical decisions.
Wearable data — including data from Apple Health, Google Health Connect, and WHOOP — depends on the accuracy of the devices and services that generate it. Brave Systems Pty. Ltd. (trading as Yates Total Health) does not guarantee the accuracy, completeness, or timeliness of data we receive from third-party health and fitness services.
7. AI-assisted features
The Service uses AI (provided by Anthropic) for several features described in the Privacy Policy, including food identification, nutritional estimation, and recovery-recommendation suggestions.
AI-generated outputs are estimates and suggestions. They are not authoritative. They may be wrong — sometimes significantly. Specifically:
- AI-estimated calorie and macronutrient values for foods are estimates only and may differ materially from actual values.
- AI-suggested recovery practices are general suggestions based on the limited context provided to the AI. They do not constitute a personalised recovery prescription and do not account for medical history, current injuries, or any factors not explicitly provided to the AI.
- AI-identified foods from photographs may be wrong. Always confirm the AI's identification before logging it.
- Your calorie and macronutrient targets may be adjusted automatically in response to your logged progress (within safe limits, protecting a minimum protein level). These adjustments are supervised by your Coach and can be reversed by your Coach. Any suggested training deload is a suggestion only — it is applied only when you or your Coach chooses to apply it, never automatically.
Coaches and Clients are responsible for verifying any AI output before relying on it for any decision.
8. Third-party services and information
The Service integrates with and links to third-party services and information sources, including:
- Apple Health (iOS), Google Health Connect (Android, where available), and WHOOP (via the Open Wearables bridge).
- Open Food Facts (a public food database).
- Anthropic (AI).
- Various Australian health information websites (Heart Foundation, Sleep Health Foundation, Better Health Channel, and others).
- Embedded exercise demonstration videos from Vimeo and YouTube.
We do not control these services and are not responsible for their content, accuracy, availability, or privacy practices. Linked Australian health information websites are provided as references; they do not constitute medical advice, and you should not rely on them in lieu of personalised guidance from a qualified healthcare professional.
9. Coach obligations and responsibilities
If you are a Coach using the Service, you acknowledge that:
- You are responsible for the coaching you deliver through the Service, including the appropriateness, safety, and quality of programs and nutritional plans you assign to your Clients.
- You must not provide medical advice, diagnosis, or treatment unless qualified to do so under Applicable Law.
- You are responsible for determining the appropriateness of the Service for each of your Clients, including any Client who is a minor.
- You are responsible for obtaining appropriate professional consent from your Clients in addition to the Service-level consent collected at intake.
- Your professional indemnity, public liability, or other insurance is your own responsibility; Brave Systems Pty. Ltd. (trading as Yates Total Health)'s policies do not cover your coaching activities.
10. Emergencies
The Service is not designed for emergencies and cannot be used to reach emergency services. If you are experiencing a medical emergency, call 000 (in Australia). Do not use the Service to seek emergency help.
11. Acknowledgement at intake
Clients accept a consent declaration at intake within the companion application. That declaration appears in the application immediately before access to the Service is granted; its current text is materially equivalent to Sections 3 and 4 of this Disclaimer and is recorded with a timestamp and a typed signature.
This Disclaimer extends and reinforces the intake consent. Where the two documents address the same matter, both apply. If you have not yet accepted the intake consent, you are not yet permitted to use the Service.
12. Limits on this Disclaimer
This Disclaimer does not:
- Exclude, restrict, or modify any consumer guarantee, right, or remedy provided by the Australian Consumer Law or any other Applicable Law that cannot lawfully be excluded.
- Exclude liability for our own negligence to the extent such exclusion is not permitted by Applicable Law.
- Operate as a release of any claim that cannot lawfully be released.
See the Terms of Service, Section 10, for the limitation of liability provisions including the application of Australian Consumer Law.
13. Changes to this Disclaimer
We may update this Disclaimer from time to time. We will notify you of material changes by posting the new Disclaimer at this URL with a new "Last updated" date. Continued use of the Service after a change indicates acceptance of the updated Disclaimer.
